Tote Rental Agreement

This agreement governs every tote rental from Binghamton Totes 2 Go. You'll be asked to confirm it at checkout. Please read it carefully — it covers cleaning, damage, the card we keep on file, and a release of liability.

1. The Rental

Binghamton Totes 2 Go ("we," "us," or the "Company") agrees to deliver the number of plastic moving totes (and any add-ons such as a hand-truck dolly) selected at checkout (the "Equipment") to the address you provide, and to pick the Equipment back up at the end of your rental period. You (the "Customer") agree to the terms below for the entire time the Equipment is in your possession.

Rentals are billed weekly. Your rental continues — and your card is charged each week — until you schedule a pickup or cancel through your account portal. Some packages have a minimum rental period that is disclosed at checkout and charged up front; that minimum is non-refundable once delivery has occurred.

2. Condition on Delivery and Return

Each tote is cleaned and inspected between every rental. If any tote arrives damaged, soiled, or missing parts, notify us within 24 hours of delivery so we can replace it at no charge. Otherwise the Equipment is deemed to have been delivered in clean, working condition.

You agree to return every tote in substantially the same condition as delivered, with normal use excepted. "Normal use" means typical residential or office moving and storage of dry, non-hazardous household and personal items.

3. Cleaning Requirements

Totes must be returned empty, dry, and reasonably free of dirt, dust, food residue, packing peanuts, tape, stickers, and pet hair. A light wipe-down is appreciated but not required.

If a tote is returned with any of the following, a cleaning or damage fee will be charged to the card on file (see Section 6):

• Standing liquid, food spills, pet waste, or strong odors • Mold, mildew, or biological contamination • Paint, oil, grease, adhesives, or chemical residue • Permanent marker, stickers, or labels that cannot be removed with standard cleaning • Cracks, holes, broken lids/handles, or other physical damage beyond normal wear

4. Prohibited Use

You agree NOT to use the Equipment to store or transport: hazardous materials, flammable or combustible liquids, firearms or ammunition, illegal items, live animals, perishable food, human or animal waste, or anything wet, leaking, or actively decomposing. You also agree not to drag, throw, stand on, sit on, or otherwise misuse the totes or dolly.

You will not sublet, resell, lend, or relocate the Equipment outside the delivery address without our written permission.

5. Loss, Theft, and Damage

You are responsible for the Equipment from the moment of delivery until we pick it up. If any tote, lid, or dolly is lost, stolen, destroyed, or returned with damage beyond normal wear, you authorize us to charge the replacement cost to the card on file. Current replacement costs are: $35 per tote (including lid), and $120 per hand-truck dolly. We will document any charges and email you an itemized receipt.

6. Card on File and Authorized Charges

Payment is processed by Stripe. By completing checkout, you authorize Binghamton Totes 2 Go and Stripe to securely store your payment method and to charge it, off-session, for any of the following:

• Weekly rental fees, automatically, until you schedule a pickup or cancel • The delivery and pickup fee and any other one-time fees disclosed at checkout • Any prepaid minimum-rental amount disclosed at checkout • Cleaning fees, damage fees, or replacement costs under Sections 3 and 5 • Late-pickup fees equal to the weekly rental rate, charged each week the Equipment remains past its scheduled pickup date

We do not place a separate refundable security deposit hold. Instead, we rely on the card on file. By agreeing to this contract, you waive any claim that a charge under this section is unauthorized, provided we email you an itemized receipt to the address on your booking. If you dispute a charge, contact us first so we can resolve it before any chargeback.

7. Cancellation, Pickup, and Late Returns

You may schedule a pickup or cancel future weekly billing at any time through the customer portal. Charges already made (including the delivery fee and any non-refundable minimum) are not refunded. Your access to the Equipment ends when we pick it up.

If we cannot complete pickup because the Equipment is not accessible, is incomplete, or no one is available to release it after a reasonable attempt, weekly billing continues until pickup is successful, plus an additional late-pickup fee equal to one week's rental.

8. Release and Hold Harmless

You acknowledge that moving and storage involve risk, including risk of personal injury, property damage, and loss of items packed inside the totes. The Equipment is rented "AS IS," with no warranty of merchantability or fitness for any particular purpose.

To the fullest extent permitted by law, you release, waive, and agree to hold harmless and indemnify Binghamton Totes 2 Go and its owners, employees, contractors, and agents from and against any and all claims, demands, losses, costs, attorneys' fees, injuries, damages, and liabilities (including damage to your home, possessions, vehicle, or persons) arising out of or in any way related to: (a) your use, handling, loading, unloading, stacking, lifting, or transport of the Equipment; (b) the contents you place inside the Equipment; (c) any third party who handles the Equipment at your direction; or (d) any failure of the Equipment, except in cases of our gross negligence or willful misconduct.

Our total liability to you for any claim under or related to this agreement is limited to the amount you actually paid us for the rental in which the claim arose.

9. Service Area

Delivery and pickup are provided within approximately 15 miles of downtown Binghamton, NY. We reserve the right to refuse or cancel a booking outside this service area and to refund any amounts paid for a cancelled booking, less any costs already incurred.

10. Governing Law

This agreement is governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Broome County, New York, and you consent to the jurisdiction of those courts.

11. Entire Agreement

This is the entire agreement between you and Binghamton Totes 2 Go regarding the rental of the Equipment. It supersedes any prior discussions or written materials. If any provision is held unenforceable, the remaining provisions remain in full force. We may update this agreement from time to time; the version in effect at the time of your booking applies to that booking.
